KALTUNES – TERMS OF SERVICE

By accessing, creating an account on, or using Kaltunes (the “Service”), you explicitly agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. Ignorance of these Terms is not a defense.
1. Definitions and Interpretation
“We”, “Us”, and “Our” refer to Kaltunes.
“You” and “User” refer to any individual, account, script, bot, or entity accessing the Service.
Any examples listed in these Terms are illustrative and non-exhaustive. The word “including” means “including but not limited to”. Actions similar in intent or effect to prohibited actions are also prohibited.
2. Acceptable Use
You may only use the Service as intended.
You must not misuse, abuse, or excessively consume server resources.
You must not intentionally submit extremely long, malformed, spam, nonsense, adversarial, or abusive input to any AI-powered system. Any attempt to confuse, degrade, stress, crash, or manipulate AI systems or backend infrastructure is prohibited.
Claims of testing, curiosity, or lack of intent do not exempt violations.
3. Attacks, Exploits, and Interference
Any attempt, successful or not, to interfere with the Service is prohibited.
This includes, but is not limited to SQL injection, DDoS attacks, traffic flooding, request spamming, storage exhaustion, logic abuse, exploit chaining, reverse engineering, security probing, or unauthorized testing.
Attempted abuse is treated the same as successful abuse.
4. Accounts and Identity
Users must provide a real, valid email address and a normal, human name.
Fake, disposable, misleading, automated, or mass-created accounts are not permitted.
We determine account legitimacy at our sole discretion.
5. Monitoring and Human Review
Activity may be logged, monitored, reviewed, and audited.
Requests and usage are subject to human review.
Do not assume automation means lack of oversight.
6. Storage and Content Abuse
You must not intentionally waste storage.
You must not upload irrelevant, malicious, or non-song content.
The Service may not be used as generic file hosting.
Reasonable usage is determined by Us.
7. Security and Credentials
Passwords are encrypted and securely stored.
Account sharing is prohibited.
Sharing credentials, internal passwords, or master access is prohibited.
Bypassing authentication, rate limits, or security systems is prohibited.
8. Streaming and Device Limits
Excessive simultaneous usage is prohibited.
Using multiple devices or methods to bypass usage limits is prohibited.
We determine what constitutes excessive or abusive usage.
9. Enforcement and Bans
Banning is a feature and will be used.
We may suspend or terminate accounts without notice.
IP addresses, devices, and domains may be blocked.
Ban evasion will result in a full domain-wide ban.
10. No Loopholes Clause
Attempts to exploit wording, omissions, or technicalities violate these Terms.
“Technically allowed” arguments are invalid where intent or effect is abusive.
Our interpretation of these Terms is final.
11. Service Availability
The Service is provided “as is” and “as available”.
We make no guarantees regarding uptime, availability, or data retention.
We may modify or discontinue any part of the Service at any time.
12. Limitation of Liability
We are not liable for data loss, service interruptions, account termination, or enforcement actions.
Use of the Service is at your own risk.
13. Changes to These Terms
These Terms may be updated at any time.
Continued use of the Service constitutes acceptance of the updated Terms.
GDPR Notice
Kaltunes processes personal data in accordance with UK GDPR and applicable data protection laws. Personal data is collected only for service operation, security, and legal compliance, is not sold to third parties, and may be deleted upon valid request subject to legal obligations.
